Aberdeen man jailed for kicking his own mum in back of head during assault

A thug who kicked his mum in the back of the head has been jailed over the “unpleasant” assault.

Aberdeen Sheriff Court was told Jay Durkin, who was given a six-month custodial sentence over the offence, could not even remember what they had been arguing about.

At the time of the offence he was supplementing medication he was on with street Valium.

The 22-year-old assaulted her during an incident on October 30 at an address on Mastrick Road.

Durkin, whose address was given in court papers as Fraser Court, Aberdeen, pled guilty to punching and kicking his mother on the head.

Fiscal depute Sally McAuley said: “At 7pm the witness was within her home address, at which time she received a phone call from her father stating the accused was going to her address.

“As they were not on good terms the complainer left her flat shortly after and began walking to her partner’s flat.”

However, on arriving she was met with her son. She asked him to leave and entered the flat, but an argument broke out.

Ms McAuley said: “He punched the complainer to the left side of her face with his hand.

“This caused her to fall to the ground, at which point the accused then kicked her in the back of the head.”

The fiscal depute added: “The complainer’s partner moved the accused away at this point and a neighbour contacted the police.”

Defence agent Jennifer Pritchard said: “He presents to the court as a young man who has an unenviable record.”

She said her client suffered from psychological conditions, was on medication and recalled little of the incident.

She added: “What he tells me is that with his difficulties at this time he was unfortunately supplementing his medication with street Valium.

“He couldn’t even tell me why he and his mum were arguing.

“He was appalled by his own behaviour.”

Sheriff Ian Wallace told Durkin: “It’s an unpleasant assault carried out on your mother.”
