A man was caught behind the wheel while more than twice the legal alcohol level – because he thought his brother was too drunk to drive.
Valerijs Beinarovics, 31, was driving his brother home after a night out because his sibling had had more to drink than him.
Depute fiscal Christy Ward said police spotted the blue Jaguar “travelling at excessive speed” and then stopping on Market Street in the city just after 2am on February 23.
She added: “Police noticed a strong smell of alcohol emanating from the vehicle.”
Beinarovics pled guilty to driving with 49 microgrammes of alcohol in 100ml of breath. The legal limit is 22 microgrammes. He also admitted driving without insurance.

Defence agent Gregor Kelly said: “It was apparent to the accused his brother had consumed more and the accused maintains he nursed three beers over the course of the evening.
“His brother went to get into the car and they had an argument and the accused thought the lesser of two evils would be he drive his brother home to get him home safely. Clearly he made a misjudgment getting behind the wheel.”
Sheriff Sukhwinder Gill ordered Beinarovics, of Rosemount Place, Aberdeen, to pay a total fine of £660 and disqualified him from driving for 12 months.
